1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ResQ Circle ("ResQ Circle", "we", "our", or "us") governing your access to and use of the ResQ Circle mobile application, website, APIs, and related services (collectively, the "Services").

By accessing or using our Services, you confirm that you are legally capable of entering into this agreement and agree to comply with these Terms and all applicable laws and regulations.

If you do not agree to these Terms, you must stop using the Services.

2. About ResQ Circle

ResQ Circle is a personal safety and emergency assistance platform that enables users to build trusted circles consisting of family members, friends, guardians, and other trusted contacts.

The platform may include features such as:

• Emergency SOS alerts
• Real-time location sharing
• Emergency voice calling
• Push notifications
• Family and trusted contact management
• Pet profile creation and public pet search
• Vehicle, baggage, and personal item management
• QR-based identification and activation features
• Emergency event history
• Safety notifications
• Future safety-related features released by ResQ Circle

The Services are intended to assist communication during emergencies but are not a replacement for government emergency services, police, ambulance, fire departments, hospitals, or other official emergency responders.

3. Eligibility

By using ResQ Circle, you represent and warrant that:

• You are at least 18 years old, or you are using the Services under appropriate parental or legal guardian supervision and consent where required.
• You have the legal capacity to enter into a binding agreement under applicable law.
• You will comply with applicable local, state, national, and international laws.

4. User Accounts

Certain features require you to create a ResQ Circle account. You agree to provide accurate, complete, and current information during registration.

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• Protecting access to your mobile device.
• Activities performed through your account.
• Keeping your contact information up to date.

We reserve the right to suspend or terminate accounts that contain false information, violate these Terms, or are involved in fraudulent or unlawful activities.

5. Emergency SOS and Safety Features

ResQ Circle provides emergency communication features intended to notify your trusted contacts during emergency situations.

When you activate an SOS, the Services may:

• Notify selected emergency contacts.
• Share your live or last known location.
• Initiate emergency calling where supported.
• Record emergency events for your account history.
• Send notifications to members of your trusted circle.

Successful delivery depends on factors outside our control, including:

• Internet availability.
• GPS accuracy.
• Device battery level.
• Mobile network coverage.
• Notification permissions.
• Operating system restrictions.
• Third-party communication providers.

ResQ Circle does not guarantee that emergency alerts will always be delivered, received, or acted upon.

6. Location Services

Certain features require access to device location. By enabling location permissions, you authorize ResQ Circle to access, process, and share your location as required to provide the applicable features.

Your location may be shared with:

• Your approved emergency contacts.
• Members of your trusted circle.
• Family members you explicitly authorize.
• Other users where you explicitly choose to share information.

Disabling location services may prevent certain features from functioning correctly.

7. Family Circle and Trusted Contacts

ResQ Circle allows you to create and manage a trusted safety network consisting of family members, guardians, friends, and emergency contacts.

You agree that:

• You will only add individuals with their knowledge or permission where required by applicable law.
• Contact information you provide is accurate and belongs to the intended individual.
• You will not misuse emergency alerts or repeatedly send false emergency notifications.
• You are responsible for maintaining the accuracy of your trusted contacts.

We may limit, suspend, or terminate misuse of emergency communication features.

8. Pet Profiles and Public Search

ResQ Circle allows users to create profiles for their pets and associate them with a unique identification number or QR code. These features are intended to assist in identifying and reuniting lost pets with their owners.

When you enable public visibility for a pet profile, certain information may be made available to users who search using the pet identification number or scan the QR code.

You acknowledge and agree that:

• You are responsible for ensuring pet information is accurate and up to date.
• You will only create profiles for pets you own or are authorized to manage.
• Public search results may include limited information necessary to help identify or return a lost pet.
• ResQ Circle is not responsible for interactions between users resulting from a public pet search.

9. User Responsibilities

While using ResQ Circle, you agree to:

• Provide truthful and accurate information.
• Keep your account credentials secure.
• Maintain updated emergency contact information.
• Use the Services only for lawful purposes.
• Respect the privacy and rights of other users.
• Promptly report unauthorized use of your account.
• Ensure emergency alerts are triggered only during genuine emergency situations.

You are responsible for content, information, or communications that you upload, transmit, or share through the Services.

10. Prohibited Activities

You agree that you will not:

• Use the Services for unlawful or fraudulent activity.
• Submit false emergency alerts.
• Harass, threaten, or impersonate another individual.
• Attempt unauthorized access to any account or system.
• Reverse engineer, decompile, or modify any part of the Services.
• Introduce viruses, malware, bots, or malicious software.
• Interfere with operation or security of the Services.
• Use automated scripts to access the platform without authorization.
• Upload content that infringes intellectual property rights.
• Collect personal information of other users without appropriate authorization.
• Use the Services in a way that could damage our infrastructure or reputation.

Violation of these Terms may result in suspension or termination of your account.

11. Permissions and Device Features

ResQ Circle may request permission to access device capabilities including:

• Location services.
• Camera.
• Microphone.
• Phone calling.
• Notifications.
• Contacts, where explicitly authorized.
• Storage or photo library.

You may revoke permissions through device settings; however, doing so may limit or disable certain features.

12. Products, Services and Purchases

ResQ Circle may offer physical products, QR-based products, digital services, activation services, subscriptions, accessories, or other safety-related products and services through the Services.

Product and service descriptions, prices, availability, applicable taxes, shipping charges, and other applicable charges will be displayed before you complete a purchase.

You are responsible for reviewing the product or service details, quantity, delivery information, applicable charges, and cancellation/refund terms before completing a purchase.

We reserve the right to correct pricing, product descriptions, availability, or other information displayed on the Services where an error has occurred.

An order is considered accepted only after successful payment confirmation and order confirmation by ResQ Circle. A successful payment does not necessarily guarantee acceptance of an order where a product or service is unavailable or an error has occurred.

13. Payments

Payments for products and services may be processed through authorized third-party payment service providers, including Razorpay.

By initiating a payment, you authorize the applicable payment provider to process the transaction for the amount displayed at checkout.

ResQ Circle does not request or store your UPI PIN, banking password, CVV, or complete payment card credentials on its own servers.

Payment transactions may be subject to additional terms, security requirements, and policies of the applicable payment provider, bank, card network, UPI provider, or other financial institution.

If your payment is successfully completed but your order, product activation, or service is not successfully provided, please contact ResQ Circle using the contact information provided on our website.

14. Pricing, Taxes and Promotional Offers

Product and service prices are displayed before purchase. Applicable taxes, shipping charges, and other charges will be displayed where applicable.

Promotional offers, discounts, coupons, and other pricing offers may be subject to separate eligibility requirements, validity periods, usage limits, or product restrictions.

We may correct obvious pricing or technical errors. If an order was placed at an obviously incorrect price, we may contact you and provide the option to confirm the order at the correct price or cancel the order and process an applicable refund.

15. Cancellation, Returns and Refunds

Cancellations and refunds are governed by the ResQ Circle Cancellation & Refund Policy, which forms part of these Terms.

Eligibility for cancellation, return, replacement, or refund may depend on the product or service, order status, delivery status, activation status, and applicable law.

By making a purchase, you acknowledge that you have had an opportunity to review the applicable cancellation and refund terms before completing payment.

16. Shipping and Delivery

Physical products are delivered according to our Shipping & Delivery Policy. Delivery times are estimates unless expressly stated otherwise.

Customers are responsible for providing accurate and complete delivery information. Delays or failed deliveries caused by incorrect or incomplete information may not be the responsibility of ResQ Circle.

Digital products, QR activations, and digital services may be delivered electronically through the application, website, registered email address, or user account.

17. Third-Party Services

The Services may integrate with or rely upon third-party platforms and technologies, including:

• Google Maps or other mapping providers.
• Firebase Cloud Messaging.
• Apple Push Notification Service (APNs).
• Cloud hosting providers.
• Telecommunication providers.
• Analytics and crash reporting services.
• Payment service providers such as Razorpay.

These third-party services are governed by their own terms and policies. ResQ Circle is not responsible for the availability, accuracy, security, or performance of third-party services outside our control.

18. Intellectual Property

All intellectual property rights in the Services, including software, source code, trademarks, logos, graphics, designs, databases, text, documentation, and other content are owned by or licensed to ResQ Circle.

You may not:

• Copy or redistribute our content.
• Modify or create derivative works.
• Use our trademarks without written permission.
• Sell, lease, sublicense, or commercially exploit any part of the Services.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for personal and lawful purposes.

19. Privacy

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy.

You are responsible for ensuring that information you share regarding family members, emergency contacts, pets, or other individuals complies with applicable laws and that you have the necessary authorization to provide such information.

20. Medical and Emergency Services Disclaimer

ResQ Circle is a technology platform designed to facilitate communication during emergency situations. The Services are not a substitute for police, ambulance, fire departments, hospitals, healthcare providers, or official emergency services.

We do not monitor emergency requests in real time, dispatch emergency responders, provide medical advice, or guarantee that assistance will be available when an SOS is activated.

If you are experiencing a life-threatening emergency, immediately contact the appropriate local emergency services available in your country.

21. No Guarantee of Service or Emergency Response

While we strive to provide reliable Services, ResQ Circle does not guarantee that the Services will always be available, uninterrupted, secure, accurate, or error-free.

Emergency communications may fail or be delayed due to:

• Internet or mobile network outages.
• GPS inaccuracies.
• Low device battery.
• Device settings or permission restrictions.
• Operating system limitations.
• Third-party service interruptions.
• Natural disasters or force majeure events.

You acknowledge that use of the Services is at your own risk and that ResQ Circle cannot guarantee successful delivery or receipt of emergency communications.

22. Limitation of Liability

To the fullest extent permitted by applicable law, ResQ Circle, its owners, affiliates, employees, contractors, licensors, partners, and service providers shall not be liable for indirect, incidental, consequential, exemplary, special, or punitive damages arising from or relating to:

• Your use or inability to use the Services.
• Failure of emergency alerts or notifications.
• Loss of data or unauthorized access.
• Loss of profits, revenue, goodwill, or business opportunities.
• Errors, interruptions, or delays in the Services.
• Acts or omissions of third-party service providers.
• Actions taken by emergency contacts or other users.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

23. Indemnification

You agree to defend, indemnify, and hold harmless ResQ Circle and its affiliates, officers, employees, contractors, licensors, and partners from claims, damages, liabilities, losses, costs, or expenses arising out of or related to:

• Your use of the Services.
• Your violation of these Terms.
• Your violation of applicable laws.
• Your infringement of the rights of another person or entity.
• Information or content you submit through the Services.

24. Account Suspension and Termination

We may suspend, restrict, or terminate your account where reasonably necessary, including if:

• You violate these Terms.
• You misuse emergency features.
• You engage in fraudulent or unlawful activities.
• Your actions pose a risk to other users or the platform.

You may stop using the Services or request account deletion at any time, subject to applicable legal and regulatory obligations regarding data retention.

25. Changes to the Services

We may modify, enhance, suspend, or discontinue features of the Services at any time. We may introduce new features, modify existing functionality, or remove features to improve user experience, comply with legal requirements, or maintain platform security.

26. Changes to These Terms

We may revise these Terms from time to time. Updated versions will be published on the website or within the application together with the revised effective date.

Your continued use of the Services after updated Terms become effective may constitute acceptance of the revised Terms to the extent permitted by applicable law.

27. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts having jurisdiction over the applicable ResQ Circle business entity and subject to applicable law.

28. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
